Advice needed on dodgy private garage

Hello, I will try and keep this short and sweet but I would really like some guidance on a situation I am currently in!

I have just purchased a 2004 plate car from a private garage.

Paid for the car on Sunday and part of the deal was to Service and MOT the car. Picked the car up this afternoon and the car was serviced but the salesman said the MOT was not due until September so he 'didn't bother getting it done'. I thought fair enough as there is 8 months remaining.

When I got home I done the MOT history check on the car (http://www.direct.gov.uk/en/Motoring/OwningAVehicle/Mot/DG_10020539) and this showed that the car FAILED its MOT on Monday 23.01.2012 for the following reasons;

Brake disc's worn.


So basically I have been lied to and the car has been mis-sold to me, where do I stand with returning the car? Can I report the garage or what else can I do?

    You should have inspected the condition of the vehicle when purchasing, to determine the extend of wear and tear on it. Cars are very complicated to deal with. The only real issue is the Offside Rear Lower Coil spring fractured (2.4.C.1a) (the Nearside Headlamp aim too low (1.8) isn't difficult to fix, the rest are merely advisories, therefore have not failed) -- so the question is baring in mind the vehicles age and mileage, what condition would you expect this to be in?

    reject the car now
    they have sold you a dangerous car with a knowingly broken dangerous spring (get another garage to confirm they havent changed it though)
    trading standards would probably go for a prosecution if you so wish to help them
    anyway whats a private garage?

    Hi I did check the car but things like gaiters and springs are not easily checked. The car was checked sunday and I was promised an MOT monday/tuesday. They carried it out on monday but did not tell me of the failure when I picked it up monday as they said it still has 9 months of MOT left so did not test it!

    Why did you accept it if you were promised an MOT which wasn't given? Not judging, just asking. If a new MOT was part of your conditions of acceptance, they can just say you accepted the car without it.

    how would they justify they entered it for an mot then and for what reason
    look out of the box
    they are trying to save costs and digging themselves a hole

    However it is a criminal offence for a trader to sell an unroadworthy car. And imo, this is exactly what they have done.

    I think they mean as in company who are not a dealership. Basically a garage that happens to sell cars (as many of them do).

    I don't understand why the garage didn't just get the spring done, very strange.

    Can be a bit of a pain of a job but with spring clamps not too onerous.
