Wrongly issued parking ticket
My husband got a parking ticket from Westminster Council for supposedly having one/two of his wheels of his scooter on the pavement.
Neither of the wheels were on the pavement, and we did take photos (although it isn't very clear). He sent a letter back saying that the wheels were not on the pavement but got a letter back yesterday not properly addressing his points, and no mention of the photo. The just reiterated that one or two wheels were on the pavement and he needs to pay the fine.
What can he do now? Should we write back again?
Any advice would be much appreciated.

I would pay it like I did if I were you, assuming the barstewards would never accept my appeal. I sent them 5 cheques worth a fiver from five different accounts along with a £5 credit card payment. Made me happy that it was at least going to take them longer to process! :rotfl: :rotfl: :rotfl:0

Was it one or was it two wheels? Surely they employ parking attendants who can count? They need to be specific otherwise the ticket is meaningless.
Appeal against it and ask them to produce evidence of the offence. Most now take digital photos, so if they haven't anything to produce tell them to get lost and put in the appeal.0 -
VKS, I do feel for you, however what street was he parked on, was it a main road or a side alley road, pavement lights etc. The contravention which is a 62 does not count if it is 1 or 2 wheels, you need to take clear pictures.
Once you have taken the pictures, go to a westminster One Stop Shop and ask the manager to show you on the system, if there are any photographic evidence attached to your case you need to take the PCN with you and id of course. Get them to print the pictures out if they can and compare it to yours, from there you can build your case.
If they can't print the pictures out or if they no longer have access to the system, show your pictures to the manager or whoever is on duty and ask them to verify if the street or place where the scooter was parked is a pavement or part of a pavement, if it is not a pavement and you regulalry park there, ensure that all this information is written down or/and into the computer system, the people at the One stop shop cannot actually cancel your ticket, but they can note things down on to the system.
Unfortunatley Westminster has now moved its pcn department to Scotland, so you are dealing with people who know nothing about London, and just answer according to the template they have been given.
You then have to write back and ask them to provide photographic evidence, this could take a while, whatever you do don't pay at this stage or they will close the case....
