Car Insurance- Accident

Hi,
I had an accident at the beginning of December which wasn't my fault. Someone pulled out of a side road and went into my front passenger wing.
I reported the claim to my own insurance company and my car has now finally been repaired by a garage of my choice.
My insurance company have sent me two letters now just basically saying they have been in touch with the third party insurers and they have still not accepted liability. However I have not paid any excess for this claim?
The last thing I heard was the third party hadn't returned his claim form to his insurers (In all honestly he probably isn't bothered as his car would of definately been a write off and wasn't worth much, it was likely to have only been insured third party).
Is it upto my insurane company to keep chasing this? If liability hasn't been admitted why have I not paid an excess?

Yes, it's up to your insurer to keep chasing.
Why you haven't been asked for an excess is a mystery, as you will see in your policy that you aren't covered by your own policy for your excess. If your own insurer dealt with your repairs, just keep your head down about the excess not being taken! (Your garage may chase you for it if they get it deducted from their bill by your insurer)
Or was your claim handled by a claim handling company, instructed by your insurer (in which case the garage bill will be being paid direct by the third party).0 -
Some insurers chose to waive excesses when they think it is a clear cut case... unfortunately whilst what one person tells you may make it seem a clear cut case it doesnt always turn out to be so.
Your insurers will continue to chase liability on your behalf but the length of these things frequently are measured in months rather than days or weeks.0
