I got a Corsa cdti on HP in October 2011 (with 3 months warranty) £4000, from day 1 had issues with; worn steering rack, CV boot, the clutch and starting problems with smoke, i contacted the finance company who told me to ring the garage to arrange for it to be repaired - which i did.

When I went in to the dealership manager spoke to me and said that it might be better (and cheaper for them ) to get me another car, anyway I agreed but said i did like this car and if the issues were fixed i would have no problems with keeping it. Anyway he kept pushing for me to look at other vechiles , which i did, the only other diesels on site were £700 - £1000 more, so i explained i couldnt afford that much more, and he also said he couldnt come down on the price of them .

Anyway my car has been back about 10 times since to try and fix the starting problems and smoke, still not fixed, so as advised with the F company i called again last week to get it booked in, only to be told the service manager was on holiday and a message would be left for him to call me monday. No call yesterday and no call today, so I decided to ring, he told me he had seen the messages but had been busy!

He told me that the dealer manager said last time it was in he would not be spending anymore money on the car, and it was up to me to pay if the warranty didnt cover up. Anyway im feeling a bit :mad::mad: now and got upset ,i told him the warranty meant nothing and this problem had not been fixed since day one, and it was their duty to fix the issue, and the contract was between the garage and the finance company not me.

I feel totally upset, i had calling them up and ive been there so many times its embarrassing i feel like im a nuisance and made to feel like its my fault by the way they speak to me .

What do i do? :(

    Contact the finance company again. Tell that the car is unusable and the dealer is unwilling to fix it. Since you bought on credit, they are jointly liable if the goods are not fit for purpose.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    they just keep telling me to contact the garage, i think im going to just tell them i want to take it to another garage for them to identify the problem and the F co can pay this. is this possible?

    This may be a point where it would be useful to contact Trading Standards or another consumer protection organisation for advice.

    But my essential point was that when contacting the finance company, you should make it their problem, not yours. They are jointly liable with the garage for the lack of car.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Just tell the finance company that you are unwilling to accept any further attempts of repair and you want a full refund. Remind them how many times the car has been in for repair and that, in your opinion, the car is not of merchantable quality and you are rejecting it as per your rights under the Sales of Goods Act 1979.

    Specifically state you wish to make a section 75 claim under the consumer credit act. They should send you forms out to fill in and return to them.
