in IVA & DRO
Does anyone know the correct way to reply to a letter I've had from a collection company called DLC?
I am now in an IVA and thought that creditors were not supposed to write to myself but to the IP but not this bunch- today I got a letter telling me the account is in arrears and sending a default notice- but it isn't in arrears under the terms of the IVA which has been consistently paid since the outset.
I am not sure they can write- or send more default notices- but can anyone tell me the best way to reply please?
My IP always tells me to ignore such letters but in my view its storing up problems for later because default notices stay on your credit file for a number of years, and now a legally binding arrangement is in place then unless that is breached surely they should just shut up now?
thanks
PS on my last post someone suggested I send this to the IP- wrong- he is only paid to administer the payments, its not his job to keep my credit file clean which is my concern here.

Hi. The DCA is just wasting postage. However, you should pass this to your IP -- a good IP WILL liase with DCA's to make sure everything runs smoothly. It isn't their only job to administer the payments, but to make sure the IVA is adhered to by both sides.
Incidentally, this will have no effect on your credit files, as, once your IVA is complete all defaults relating to debts in the IVA must be dated on or before the start date of the IVA. Many creditors will add defaults right the way through the IVA.
There is also a good chance that this DCA has purchased your debt and the IP should be made aware of this as it is now the DCA who should be gatting the dividend.0 -
I too had a letter from a company stating they had bought my debt from one of my original creditors in IVA. I thought this very strange to buy a debt where they were only going to get at best 20% of it back!!!!! The original creditor must have sold it for pennies or conned the company buying it????? Would not have thought ur letter is anything to be concerned about though.0

they do sell them for pennies, techno. Apsrt from giving some other company the hassle of messing around for 5 years, it clears their books of toxic debt and makes their company look better financially.0

you would have thought if the original creditors would accept massively reduced payment for the debt they would offer it to the debtor to pay and clear their name?????...Strange the world of finance is???0

Yes, I have often thought that -- be far easier for all concerned --- but too simple I guess !!0
