Faulty PS£, YLOD. Where do I stand with Sony??

I have owned my PS3 for around 6 years now and last week it decided to go YLOD on me (Yellow Light of Death).
As there are many business on the internet that are able to repair the console I decided that because of the age (and my all important save data) this was the most viable option for me. I made sure I was careful in picking the right company and sent my PS3 off for repair yesterday.
Phone call today to say that the PS3 is unrepairable due to severe oxidation on the graphics chip and to be honest the guy that phoned sounded more sorry than me!!
Now what I want to know is:
As this is a common fault and was even on the watchdog tv program in my eyes this is a manufacturers defect, so where do I stand with Sony?
I think of it as a comparison to a vehicle recall, i.e if a car manufacturer had a fault with one of their cars from the production line they recall them all and the customer does not have to pay a penny for the repair, is this not the same thing with the Sony PS3?? As it is a clear manufacturing defect?
Any help would be greatly appreciated.
Regards and thanks in advance.

It really depends on the life expectancy of the PS. Many would say 6 years is reasonable -- if so, even if the fault is inherent, the goods still conform to contract and have been of satisfactory quality so you have no comeback.

You would also need to prove the fault was inherent, if they refuse you have no choice but to accept this. You will be unable to go to court over it due to statute of limitations.

If you can't afford a new one then that's unfortunate, but not Sonys problem.

I'd recommend you not waste much time on this one as you are extremely unlikely to get anywhere with it. Nothing lasts forever, save up and Go buy a new one. :D

The thing is, even if you only purchased the PS3 two or three years ago, you still wouldn't have any comeback with Sony unless it was purchased directly from them.

Any legal rights you have under the Sale of goods act are against the retailer who sold you the goods and not the company that manufactured them.
In any case, the SOGA has certain conditions with regards to faulty goods and one of these is that you only have up to 6 years to attempt to claim for faulty goods (this doesn't mean that all goods are expected to last 6 years), and after 6 months, you are responsible for proving that the fault was down to a manufacturing defect.

Even if the retailer did agree that there was a manufacturing defect, all they would have to do is to offer you a refund of the price you paid, but they are allowed to make a deduction to cover the time you have had use of the goods, and in my opinion, after 6 years, any refund would probably be next to nothing.

Six years is a good life for most household electronic item, so I honestly think that you would be wasting time and money chasing this any further.

You have no recompense against this. The best you could do is write a well worded letter to sony appealing to their better nature to repair it or try and get some form of money off coupon.

If im honest i wouldnt bother and would buy a new one (actually i wouldnt, i'd go and buy an xbox) alternatively, save up for a new machine, if your doing the latter, i believe there are rumours surfacing about the announcment of upgraded machines from both manufactures towards the end of 2012 or early 2013.

Its a shame sony customer services doesnt appear to be as good as microsofts.

As mentioned, any comeback would be against the retailer and statute of limitations is 6 years from purchase in england (5 years from discovery in scotland).

That doesnt stop you asking for a goodwill gesture though, it just means you have no legal entitlement to one.

If they wont give one, sell it for parts on ebay, probably wont get much for it though :(
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • His advice was correct. 6 years? Seriously?

6 years ago I was 16... I can hardly remember that far. You'd have to be mad to expect a free repair or replacement on a games console after that length of time.

If you write to Sony, your letter will be filed under 'bin'.

Harsh, but true. I'd put it on eBay and try and get something back that way. :)
