cancelling advertising contract help

I am self employed and was talked into an advertising contract in a school folder i paid 7 months ago and have had no leads at all form this deal
I have tried talking to the company who sold me this but they will not let me cancel the second year even though I have had no business at all and I doubt that my details have been shown to any parents in the school

any advice please

    Your only get out is if they did not print the folder or failed to distribute it. If they did not send you a sample, I would suggest you write for one. And then pop around to the school and find out if it was ever distributed.

    If fighting it on the basis you have not received any leads then this depends on your contract -- it is likely though they are offering merely the advertising space in the folder, so actually getting leads isn't part of the contract.

    If though they haven't fulfilled the contract by putting the advert in and distributing it in the manner expressed you may have a case. You may though have to prove they haven't fulfilled their side of the contract. Ask them for a copy of the folder or something firstly.

    The chances of getting out may be slim, particularly with this being a business-to-business contract.

    I know someone that signed a contract for physical space in a shopping center for promotions for the 12 weeks leading upto christmas. They changed their mind and informed the company of this -- the company rejected it and did nothing in terms of mitigating their losses (ie finding somebody else). The company then ensured the space was available for them had they changed their mind. This woman didn't use the space, nor try to sell it on and was taken to court shortly down the line for the costs (about £5k I think), she lost!
    The point is, with consumer contracts, similar situations you would be liable for their losses only if you breach the contract (a recent gym case also confirms this) - however with B2B contracts this isn't necessarily the case so you may need to come to some arrangement.

    If the firm that sold you this is based in the 'north west triangle' [l'pool, manch, chester] then it's a great big con.

    They promise much and deliver nothing.

    Google something like 'wall organiser scam' and read.

    Also worth searching hospital magazine, police magazine ect ect. There are some quite common scams in the world of advertising. Alot of their offices seem to be based in Manchester (take from that what you will).


    Maybe worth checking the company out op, if it seems like one of these companies they'll probably make a bunch of idle threats and you'll never hear from them again.
    Still may be worth filing a formal complain with them requesting details of the publication in case this isn't the case in your instance.
