Maternity Pay

Hi,
My friend is currently pregnant. She works as an apprentice full time and earns around 12k a year. She currently meets the criteria for SMP. However, she is on a 12 month fixed term contract. She has worked out that her contract ends 13 weeks before her due date. If the company do not decide to extend her contract will she still be able to get some form of maternity pay?

  • To qualify for SMP you must have been:
    • employed by the same employer continuously for at least 26 weeks into the 15th week before the week your baby is due (the qualifying week).
    If your friend meets the above condition then she will be entitled to the full 39 weeks SMP from her Employer regardless of the fact she is only on a 12 Month Contract.
