10 year building warrenty

Hi all,
I took some tile off my wall as they were lose so was going to replace... but the wall behind (plasterbored) was damage by water & very damp.. I since then cut a bit of plasterboards to see if it went through brick wall but no that ok. Now I had 3 tillers round for quote and after accessing the damage they all turn to me and ask how old the house was!! I said 4 years old. They all say that I should get it al done under warranty. Now this is my problem, I spent all day looking at my Mortgage, solicitor’s paper work etc phone them and none off them knows. I have the builder name but can’t get any trace of him. What other options can I do?? We (the 4 flat owners) are now the free holders in last 2 years and they have no ideas either! The tiles was letting water in due to wrong stuff being use... eg Normal plasterbored not waterproof or TANKED. The guy that did it in the 1st place I believe has gone bust. Is there anything I can do to find out who owns the warrant or 10 year guaranteed Cert??

    are your Insurance company asking you to find out where the warranty lies? This shouldn't be down to you.

    I would call them back and say that you can't trace the original builder, but it looks they have gone bust and offer to provide them with the information you have.

    It should be down to the Insurer though to claim their money back, following the claim.

    This is how it always worked in my experience anyway - so get back on the phone to them

    If they are talking about the builders warranty and he's gone bust then I'm afraid you are probably stuffed.
    If they are talking about NHBC then google for NHBC and phone them, they should have records for your address. Whether this issue is covered by the NHBC I don't know but it's worth a phone call.

    I would NOT go through insurance if you have cover from the NHBC for this.
    You can make a claim through your insurance if you want but your future premiums will rise through having a claim and you will lose any claim free years you have.
    Why would you want to do this if you can make a free claim on the NHBC warranty? so I would check that first.

    I don't think this would be a home insurance issue. Most exclude things like:-
    damage caused by faulty or unsuitable materials, design or poor workmanship

    I also doubt that an NHBC warranty would be any use - even if it does exist. I understood it to be for structural or building regulation issues.

    Your solicitor should know what guarantees or warranties came with the house when new. He should also be able to tell you if you could have a civil claim against the builder. Any civil claim would of course require the builder to still exist.

    Hi all thanks for your reply.. RS65 - Building insurance already said they they will pay out but as they said it only 4 years old and bad workmanship it will be covered under warrenty..
    I know the Builder.. But cant get hold of him or address.
    i have a survyar cert which states that the building in good condition and was built correctly.. has builder name so im hoping i can get phone number from them.
    I paid for that flat and thou it only 500 quid job to rip the lot out and replace i expected more than 4 years out of it.. i did alot of repairs and redone a few things myself eg bathroom lock wrong way round so only could be lock from the outside

    I been told all new build gotta have 10 year warrenty or no bank will loan you the money......

    Yes, this is the NHBC - National House Builders something, but it does not cover everything.
    It would not for example cover locks put in the wrong way round.

    You should have had a booklet and I can dig mine out if you can't find the info on the internet but I expect you should be able to find out what is covered.
    As already stated it tends to be for structural and building regs issues, so it won't cover every internal issue.
    The NHBC are very thorough at what they do but it is not a warranty for absolutely everything.
    Check out the cover but if you get stuck then let me know and I'll check my booklet.

    Not true, it could be a Professional Consultants Certificate which is valid for 6 years and acceptable to most lenders. Only builders who are registered with the NHBC can get a NHBC warranty (other warranties are available).

    The house I am in now had a builders guarantee for a year and an architects certificate. This was acceptable to Hbos when the house was new and YBS more recently. The builders guarantee covered everything for 12 months but the possibility of holding the architect responsible for a problem like yours is a bit unlikely.

    Interesting that they'll pay despite saying its a workmanship issue. Out of interest, does your home insurance policy mention anything about workmanship?
  • No it doesnt that why i was shocked!!!! Though what if you buy a new house 2 years later it falls down because of bad workmenship you lose the lot and wont get a payout !!!!
