  • I honestly believe that people are not treated differently as regards claiming benefits, it is illegal to do so.

    If someone has been accepted whilst someone else has been refused, then there must be different circumstances. If the circumstances were the same, they would be treated the same.

    Maybe the person you are referring to hadn't told them s/he was in Spain?

    However, most benefits are NOT transferable abroad, but IB is, providing you continue to meet the requirements.

    Also, to receive IB or any other benefit in Spain, you have to be resident in Spain, otherwise you will claim it in the UK.

    I had binned the paper, but came accross a copy whilst we were in our favourite watering hole enjoying coffe and a brandy. Had another look at said article and it does not mention IB, sorry. I have no personal experience and I am sure you are right.

    The paper does refer to Mr A.Votier who has been refused DLA and a Mr RJ Hackett who is in receipt of DLA and has a letter from the EU to support his claim. I have no idea of either person's circumstances, but it seems they are both resident in Spain.

    I am not suggesting that the benefits agencies are doing anything underhand. My point was, I am not sure that rules are always enforced correctly. They can be complicated to interpret and mistakes are made.

    PS: One of my neighbours claims winter fuel allowance. I would not have the cheek to even try.

  • If you were eligible to claim winter fuel allowance before you left the UK, you can still claim it in any EU country! :eek: :rotfl:

    To get Disability Living Allowance you must be in Great Britain, or be treated as living here, and meet certain other conditions about your residence and presence.

    It is, as you say, necessary for people to check on their own particular circumstances before making any decisions.

    TBH, my husband was going to sign off IB before we came here, as he assumed he would not be able to continue claiming it, then someone told him it was possible to claim it, so we enquired and it was all quite straightforward.
