Need some advice please?

We just recently bought a fireplace a fortnight last saturday & paid £817 for the whole lot however the next day we changed our minds & on the Monday we decided we didn't want it and asked for a refund. We contacted the shop & told them of our intentions to cancel & they said it was policy to write to head office a letter of why you want to cancel & then they should be able to refund. We did this (recorded delivery) & have today got a letter back stating they weren't going to give a refund because we just simply changed our minds? I'm I right to assume that under the sales of goods act 1979 I'm entitled to a 7day cooling off period & by law can expect a full refund?

What should I do?

    If you bought the thing in a shop then you have no statutory right to a refund simply because you have changed your mind.

    You may however have a contractual right if you were advised before the sale that "you could return the thing if you changed your mind in the first nn days".

    If you purchased online or by mail order or phone, then you can cancel the order for a full refund upto seven working days after delivery.

    yeah it was bought in a shop looks like I'm screwed then, will just have to find something else :(

    I thought fireplaces were built to order, akin to buying a suite from Land of Leather. I could be wrong but if it was bought in the shop pre built, I cannot see why they wont refund you, unless it was built to order or it has already been delivered to your home.

    No it wasn't made to order & we cancelled almost immediately (next working day) but by that time they'd taken the money?!:(

    If you don't want it, you can breach your contract of sale and receive a refund -- however, they can deduct their proovable losses as a result of your breach, this may include an admin fee and other losses (note, the wholesale cost of the item isn't a loss as they can re-sell it).

    Inform them by registered post that you will be rejecting delivery and are hereby cancelling the order. Also state you expect a refund within 30 days and any deductions made to be fair.

    Definitely, cancel it and tell them to keep it. If you dont collect it, you dont have it. You can always do a chargeback on your card if they refuse to refund.
