ib jsa and guardians allowance

hi
hope someone can correct my confused brain... i was laid off from my seasonal job on 6th jan and claim jsa that day, my interview and sign on was the 9th jan, i had to go in and sign on again on the 12th jan and am next due to sign this thursday 26th jan. I received a letter today stating that i would receive income based jsa as i had not paid enough nat ins for april 10/11, also it sated that there has been 14.75 taken off because it was income i had coming in. Now this 14.75 is guardians allowance that i receive for looking after my niece following her mums death.
After doing a bit of searching the results say that this money should not be taken into account for my jsa, i have phone the office but have to wait for a callback from them while they investigate it. Also they said i will only get 1 day jsa after i sign on again because of losing the first 3 days, i worked it out more than that but so confusing.:eek:
So before i get completely flustered when they call back, can they really stop my guardians allowance ??

Are you sure it's Guardian's Allowance, and not something else - a payment from a trust or insurance policy perhaps? Is there any other income aside from benefits?
You will never be paid for the first three days of a JSA claim - they're called waiting days and everyone who claims has to serve these. However, looking at your dates you have a live claim from 6th Jan (if this was the first day you didn't work) until present and you will therefore be paid from 9th Jan until 12th Jan as your first payment - so four days money. When you sign on again on 26th Jan you'll get money from 13th Jan - 26th Jan three working days later assuming you've met the conditions. Your first and second payments may come as one.
The difference between income based and contributions based won't affect you - it's the same amount of money, eligibility is based on different things but you're on the right benefit if you have no other household income.0 -

I am 100% its guardians allowance, it is paid in with child benefit.
I also get ctc and dla, on my application the assistant put down all 4 amounts i recieve individually, i.e ctc, dla,cb and ga and the 14.75 is the guardians amount.
Still waiting for a callback, they did say it would be today but i suppose i shouldnt hold my breath.

They should disregard your guardian's allowance. Point them to paragraph 28365 of the DWP decision makers guide.0

Guardian's Allowance doesn't count as income if you're claiming tax credits, Income Support, income-based Jobseeker's Allowance or income-related Employment and Support Allowance. It is paid on top of these benefits.I made a mistake once, believeing people on the internet were my virtual friends. It won't be a mistake that I make again!0
