Please help? Can anyone tell me if It will affect any arrangement I have with a Debt Management Plan if you try to claim any of the above whilst still having outstanding debt?

Yes it will. Any redress payable on a successful complaint can be used to go against amounts written off, arrears/defaults etc before it comes to you.

Apart from that no. Never use a claims company in your situation. Even if you dont get a penny as it all goes against debt, the claims company bill you on the redress payment made by the lender.

So can I confirm then, as most of my charges are for credit cards one for bank charges, a lot of them have been passed to debt recovery companies. Do I get in contact with the credit company/bank direct to try to reclaim. Will this have any affect on the arrangements I have in place as with most of them I am not having interest charged at the moment? What I would like to know is if I put in a claim can they then pull out from the agreement I have with the debt management company to then say i have to pay interest?

You complain to the bank/card company.

    no.

No. The only thing that should happen is that if you succeed in your complaint that they can first use the redress payment to claw any amount that was written off reduced. Then they can use it against the amount you owe. This will reduce what you owe but you should be able to continue paying as you are until it is cleared.

I have some further questions which you may be able to help with.

My partner purchased a car through Welcome Finance some years back I believe he may have been misold PPI. He then got into financial hardship and he was taken to court and an order has been placed on his property, I am not quite sore of the name of it but basically if he sells the house he has to repay the debt and also if he fails to repay the monthly payments they could try to get the money back through the property being sold. Again if he tries to reclaim PPI and I think there may also be charges will this have any affect on the court order that is against the property?

Another question charges that I incurred on catalogues and possible PPI can they be reclaimed?

Last question, I stupidly purchased a holiday online maybe about 10 years ago or so now, It was a scam I believe. Am I still able to try to reclaim it back as I paid with a credit card? It was with one of the cards that are on my debt management plan?
