gearbox cracked-they claim it is our fault?

Hi Guys, I really hope you can help.
We bought a second hand gearbox from a salvage yard in Hull.We paid by card over the phone and it arrived two days later. Hubby took it to the garage to be fitted and found it had a crack in the casing,but assumed that it was sent like this, as it was from a salvaged car.The gearbox did not fit, it was from a newer model car and various things did not match.
I called the company that same day to arrange collection and they picked it up the day after.On the Friday we called and asked for our refund as they had received the gearbox back on the thursday.
The bloke said 'yep,I have checked it over,its ok.I will get someone to call you to issuea refund monday.Monday arrives,no phone call.We call them and he says 'someone will cal either tomorrow or wednesday to issue the refund'.
By this time, i am getting annoyed-dont you usually get a refund straight back when u return goods?
Wednesday evening comes, we call again.he says 'someone will cal tomorrow or friday'...yep you guessed it,no-one calls.So,we call Friday evening.He finally agrees to refund but then says that the gearboz was returned with a big crack in the casing and they will only give us £50 of the original £85 back as they have to repair it.We explained that it was received like that so he asks why we didnt tell them...errmm..it was from a scrap yard we dont expect it to be perfect.
We tell him to claim the money from the courier as it is obviously been damaged in transit he says 'no,i cant do that, thats dishonest'...yet he can quite happily accuse us!
He said he will talk to his boss again and call us tomorrow.
so,my question is,where do we stand?thanks for reading this far!

also to add, when hubby called and said it was the wrong gearbox etc he said 'oh,thats the second time that has been sent back as the wrong gearbox'.one would think he would learn from the first time!0

There seems to be some disagreement when/where the crack appeared.
If it were me, at this stage I would accept £50, and make a mental note to only buy secondhand goods face to face where they can be inspected.
The trouble is that you have no proof of when or where the damage happened.0
