Disputed Car parking fine!

Hello everyone, doing this on behalf of my dad who received a parking ticket on the 22nd of December last year.
Basically he used a car park in Birmingham city centre which had put in-place a new system of requiring a car registration to be entered when purchasing a ticket for the ticket to be valid. He hadn't used this car park for a while and was not aware of the new system and so bought a ticket without entering his registration. However the ticket still issued the ticket, because there was no registration linking the car to the ticket he got a fine and is refusing to pay basically, arguing that if entering the registration of the car is mandatory for the ticket to be eligible then the machine should not issue a ticket without making you enter the car reg. So just wondering if he has/we have a leg to stand on with this argument. Obviously he is not just trying to clasp at straws but was instead an honest mistake.
Any advice would be much appreciated, thankyou for reading. :)

  • Assuming this is a council ticket then a trip over to pepipoo.com and post there. If its a private ticket then just ignore it.

    Can you just confirm who exactly the ticket is from ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    If private car-park, ignore. You have paid the landowner for the use of his/her land by purchasing a ticket.

    If a council car-park don't ignore it, post over at pepipoo.

    Generally if the payments & appeals have to go to a PO Box it's private.

Previously appealed but surprisingly rejected and told must pay £60 by the 24th of January. On the off chance that court proceedings are issued what would you advise?

    Why on earth would you appeal to a company like this? You've taken it far too seriously.

    VCS (part of Excel) are well known on here, and for the 0.001% of tickets they've tried to pursue through court, they've taken a fearful hammering.

    Ignore all correspondence unless (unlikely in the extreme) you receive stamped court papers with a case number - you've more chance of reading about Graham Norton's engagement to Britney Spears in tomorrow's paper.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     On the absolute non-existant chance they took him to court they would have to prove their charge was consistent with their losses incurred. Seeing as their losses were nothing, as your Dad bought a ticket then they cannot prove this is anything but a penalty which is unenforceable under contract law. So they won't do court, becasue it is unenforceable. So ignore entirely.

    Parking was paid for so what is the loss the PPC have suffered? The answer to that is nothing whatsoever. Just ignore the chancers, but hang on to the proof of payment just in case.

    Glad to see it is meaningless invoice by a bunch of chancers, as you can see its important to say who the issuer of the ticket is as the advice is different. Be thankful that you came here first before paying, you have just saved yourself quite a few quid :) as mentioned above just ignore the scammers they have no right to any of your money, and don't deserve anything but derision from you.

    If he paid, end of. Simply ignore them.

    Your dad's logic is correct. Consider buying a pint of milk and then not being able to find the receipt in your pocket when you got back to the car. Could Tesco demand you pay £80? Of course not.
