Overturned parking ticket

A few weeks ago I puchased a car park ticket outside my place of work. It was a very windy day and I placed the ticket on my dash the right way up (They do not have any glue on them) When I returned to the car I had been issued with a PCN. On checking the ticket I found that it was upside down. I know that I placed the ticket correctly and can only think that the wind must have caught it when I closed the door. I have appealed and sent the ticket to the Local Authority with a letter of explanation, but they have rejected my appeal. Should I pay up or follow my instinct to carry on with an appeal?

    You sent the ticket ? I hope you mean a photocopy of the ticket and you still have the original ?

    Okay as this appears to be a council ticket, I would advise posting this on Pepipoo they have quite a lot of people there who can help you, they will need to see a scan of your PCN front and back, just remove anything from the images that identify you, and your rejection letter and the wording on the appeal you used etc

    Yep, get over to the pepipoo forum linked, read a few threads and the FAQs over there so you know what pics to provide and how to show them on your thread. Don't start a thread without pics or it will plummet off page one without much advice.

    In the meantime also Google 'fluttering ticket penalty' which will give you various forum results of other people in your shoes. It should also find you the Chief Adjudicator's Report from 2006 which has a whole section on people who have appealed 'fluttering ticket' PCNs like yours. Many successes to quote!

    Definitely carry on appealing - I would almost never recommend people just fold when the Council say no at this early stage. Most Councils just send a template/tweaked rejection to almost ANY informal appeal. It's a game of bluff to them, all about money IMHO. It almost never means you don't have a case.

    Let us know when you win with pepipoo's help. Most people WIN at adjudication or the Council give up when they see you mean business.

  • I'd challenge them on it. Write back and tell them that their decision was unreasonable in the circumstance and invite them to resolve the matter in court. It will be magistrates' but given the nature is still one of dispute, there is a chance you win and defeat will not go horribly against you. They are playing the bureaucrat, it is patently obvious that you committed NO INTENTIONAL VIOLATION whatsoever, and I cannot see the courts jumping straight onto the side of the authority.

    Think you are getting confused here, this won't go to a magistrates court, it will go to an adjudicator, and if it is appealed to there with pepipoo help the most it will cost is the full price of the ticket without the discount, and there is more than fair chance the OP will win.

    The exact same thing happened recently to a friend and the local authority revoked the ticket.

    Hi some of these tickets are of poor quality,ie they do not have any adhesive or sticky backs to affix to car with
    You could argue that this was the cause of the ticket blowing over
    I am never very keen on tickets that are just laid on the dash,too easy to be misplaced on a windy day
