Do I appeal or not?

I had the results through from my recent ESA medical a week or so ago and have been placed in the WRAG, now I feel this is wrong and would love them to find me a job where I can take my husband (or other trusted person) and it finishes before it gets dark, not to mention the fact I have serious panic/anxiety attacks using public transport (to name but a few of my problems, not forgetting the depression etc.) The issue I have is my husband has recently got a little part time job which means we will be coming off ESA beginning of February (my other carer will be with me when my husband works) and claiming working tax instead, is it pointless me appealing the decision made?

You need to work out what grounds you have to appeal.
Appealing the decision simply because you don't think you should be in the work-related group, without understanding why you might be eligible for the support group is probably a bad decision.
http://www.dwp.gov.uk/docs/m-06-11.pdf - page 13 and on - the grounds for entry into the support group.
In addition to these, there is one more 'It would be dangerous for the health of any person if you were put in the work-related group'
The work-related group will not mean you have to either apply for work, do work, or go for medical treatment.
It can involve anything else that's considered reasonable.
In most peoples case, it's one 15-30 minute interview every few weeks.0 -
Can anyone help? i had the dreaded brown envelope through the letter box which has placed me into the wrag work related activity group without a medical! i intend to appeal as i have a long term disability since 1993 i have looked on the link for criteria for the support group and believe i fit into the support group i know i only have one month to appeal which is not very long for me to collect more supporting evidence i know people with the same condition as me are being put into the support group and i wonder if my appeal would be weaker if i have not even had a medical:mad:0

Yes, your case may be weaker without a medical, if that medical would have found you to qualify for the support group.
Phone up tomorrow, and ask for a 'written statement of reasons'.
This increases the time limit to appeal another two weeks, or two weeks after the written statement is posted by them.
You may not get paid until your actual appeal is submitted however.
If you could elaborate on your condition, people may be able to better comment.0 -
It's very hard to get into the support group, this group is supposed to be for the indefinate unable to work.
I'm in the WRAG and it isn't too bad initially, I was left alone for almost a year of claiming..
if it was me I wouldn't gamble with my current award as it's still really hard to get into the WRAG, they are not asking you to get a job as such just asking you to take the pathway to getting a job with their support..[for now that is]
You will have to engage with them and they can be a pain to deal with..
I cry infront of them or on the phone it works..I always take the moral high ground, it's lovely up here...0 -
i got put in the work related group thing too and i see them once a month at the moment, two women come to my house, there is not much pressure at the moment but they are trying to get me therapy, i say they are but really it is me ringing around and re-searching! lol try to get them to home visit as they will then take you more seriously as if i went in im sure they would push me further than i can go. ( i have depression, anxiety , social phobia and agrophobia ) but all i can say is this system is messed up i have been begging for help for 10 years and have never been able to hold down a job from all my problems pluss i left school early so did not get GCSE's and i have 2 year waiting lists for therapy and the NHS dont care but as soon as this new thing comes along we all have to pander to them! if they had helped me in the first place i would'nt have got this bad!
The woman i am with doesnt work with targets and i have 2 years with her! (i dont no what happens after 2years tho)
I was going to appeal but didnt see the point because there is no way someone like me will get on the support group, it is only for people who are dieing or who are so disabled that things will never get better, with people like me it changes all the time so they will never put me on it!
I am trying to get higher DLA and carers but its been a no go at the mo, im finding i need more help but they aint having any of it! I tell you something tho anyone who judges us for being on benefit just for the money can bog off, you can't live on it i barely get by on it and TBH its not a choice its a necessity.Thanks every1 for making this website what it is, its helped me alot in the past!0
