in Cutting tax
Hello,
I just received my P800 calculation from HMRC on 21 January 2012 for the tax year 2008-09. They said I had two employment for the above tax year and received full tax year allowance on both jobs. On the basis of their calculation I owe them tax of £1397.20 for 2008-09. I would like to brief outline about the figures they have mentioned on my calculation.
1. They have mentioned £15040 as my PAYE income for the above year. However the actual PAYE income was £13761.54 as I have got my P60 from both jobs.
2. I also got tax coding notice in January 2010 from HMRC where they have disclosed that they reduced my tax code from 647L to 350L for 2010-11. Therefore, I thought my tax affairs were in order due to the fact that they should have received correct information from my employer and they rectified that I have underpaid tax for 2008-09 and therefore they reduced my tax code for 2010-11.
Need information and guidance for following:
1. Can I apply tax giving up under ESC A19? The reason behind this HMRC have not acted in timely manner as they should have notify me within 12 months of tax year end.
Can anybody please throw some lights on the above and guide me to deal with HMRC?
Regards

As you are aware of the term ESC A19, a simple search on the site will produce a multitude of results. - One word of advice, if you see the poster is Chrismac, ignore the post it won't be relevant, it will refer to hundreds of such cases, - oh no he changed it to 25, hang on a second he changed it to 20,
What is your current code? does it include an underpayment in it? - refer to the P2 notice of coding issued to you in Feb/March of 2011 for the tax year 2011-12
When your code was reduced in Jan 2010, was this code operated by the employer? did it appear on the payslips for 10-11
Did you receive any benefits in kind and a P11d ?
post more information and people will be along to help, of course some people will be along to have a pointless rant and introduce the word tribunals but they can safely be ignored. He's not an accountant - he's a charlatan0 -

Well based on your income figure of £13761 and tax paid of £739.40 you would be underpaid tax of £805.80 for 2008-09. We need to know how the code of 350L was made up for 2010-11 - do you still have a copy of the coding notice.
You also need to find out why HMRC think your total income was £15040 in 2008-09, but even if it was this would not bring out an underpayment of £1397.20 - can you post up full details of the P800 please.0 -

The first thing you need to highlight is the fact that you've noticed the total income is wrong. Get them to correct that first and then appeal if you think they didn't act on information received in a timely manner. This is a system account and does not represent a real person. Yes I have coding notice for 2010-11 where they changed my tax code to 350L. I spoke to them on Monday and they said it was due to split in allowance as they thought I had two employments in that year.
I have sent them my original documents (p45, p60etc) for them to correct my earnings on P800 calculation yesterday.
I have applied a review under ESC a19 and they refused my claim as they think my case will not fall into requirements of ESC A19. However, I think my case is pretty straight forward to fall under ESC A19 as I completed P46 for all the employments I did in 2008-09. Moreover, they said they sent me tax code letter in August 2008 for one of my job however I have not received any letter at all.
Please reply your comments how to go ahead with any recommended actions.0 -

That would depend on what box you ticked on the P46 form and whether the jobs ran concurrently.0 -

Perhaps to post up the full detail from the P800. As (see post #7) the detail you have provided doesn't seem to add up very well?If you want to test the depth of the water .........don't use both feet !0
