Grrrr Currys Grrrr

Hi all,

I bought a Hoover Pet Peformer vacuum cleaner from Currys on 22 Dec 2006, so it's less than 2 months old, well husband bought it and got conned into taking out an extended warranty for £9.99 for 3 years.

Anyway, the stupid thing broke last week, just wont's switch on and when it does, it goes on for about 3-4 minutes before cutting out.

So we took it back to Currys (NB I hate Currys but they are local and huuby couldn't find another pet peformer 3 days before Christmas!) and before we took it back I rang up and asked if they had the hoover in stock and was told they had and they would put one by until the end of the day, this was about 5pm I got there by 5.20pm.

When I got there, I was told they didn't have any in stock and nor did any stores in the locality and I could only exchange it for that model. So I asked for a refund and the manager came over and said I couldn't have a refund.

He offered me a display model of the hoover and as we were desperate we took it, now that has developed a problem too, similar as before but instead of cutting out, it loses suction and gets quieter until it stops.

Now, obviously I want to take it back and I want a refund or to choose another model, so my question, is A) am I entitled to have a refund because this is the second model that broken and B) what are my rights in this situation?

  • currys have a policy where if the item is faulty they will only refund in the first 28 days after you have made the purchase but I am not sure whether this is entirely legal

  • You were entitled to a refund the first time round, but Currys being Currys wouldn't let you know this of course! It is all covered under the Sale of Goods Act, hoover isn't satisfactory quality, you are entitled to request repair, replacement or refund. Go back, talk to the manager, don't take any rubbish about contacting the manufacturer, or any timescale their policy might state, the law will always override their policy.

    If you don't get it sorted this way, write to them asking for replacement/refund, and if that doesn't work, then contact Consumer Direct for a referal to Trading Standards.

    The moral of the story, DON'T SHOP AT CURRYS!!

    Just what YM says - however just to avoid getting hopes up of intervention, not all Trading Standards departments will be able to assist further as many of them are under-resourced and cannot offer intervention in civil cases. Note that they can't enforce the Sale of Goods Act either.

    However you definitely should do as she advised, and if you do not get a response to this letter then make sure you write one entitled "Letter Before Action" and make it clear that you will be taking the matter to the small claims court if necessary if they do not sort the matter out by a given reasonable date. This often helps move things along!

    Keep copies of all your letters and obtain a proof of posting slip from the Post Office.

    Becasue your complaint is now to goods that were replaced, you should quote the Sale and Supply of Goods and Services Act, and not the Sale of Goods Act in your corrsepondance
    Don't bother trying to sue me - I've got no money!
  • Doesn't really make any difference as the Regulations are within the Act as an amendment anyway.
