Bank Charges on a Default Account

Heelllpp! I have written to Capital One to claim back my credit card charges. Today I have received a written response from them stating that they will not refund my charges as my account has been in default? Before I send the next letter I just wanted to know if this is correct. Am I unable to claim because of the default or shall i send the letter threatening court - any help will be much appreciated. Thanks xx

There's no automatic right to get credit card charges back.
Did you actually default on the account? If you did, then even if the do owe you money (which I'm afraid I doubt) they'll be allowed to knock what they owe you off what you owe them.0
