Section 75 / Chargeback help

Options
Hi,

I purchased a car bumper on Ebay, and prior to purchasing the item I emailed the seller with the specifics of my vehicle, to confirm it would fit. I have an email from him affirming it was made for my model of vehicle, and it would fit perfectly. I paid for the auction on my credit card (£115) which was for a primed (ready to be painted) front bumper.

Fast forward 2 weeks and I took the bumper to my auto shop to have it sprayed, and as is always the case they sprayed it first, then attempted to fit it. It was then found that it would not fit at all, the shape was correct but the fixtures completely different and without welding and extensive work on my vehicle would not fit.

After speaking numerous times with the seller (email first, then phone) he agreed to refund me for the bumper, and pay to have the item picked up by a courier.

My issues are:

1) I dont want to send a professionally sprayed bumper back to the seller, who will in effect get more money selling it on now I have had it professionally sprayed

2) My body shop does not accept credit card payments, so I am having to pay cash to pick up my car (will have an invoice)

3) The ebay seller has agreed to refund the cost of the bumper, but says he does not have insurance to claim from the company who supplied the bumper, for the spray cost I have incurred.

Not sure what to do. Spoke with my credit card chargeback team who say that as it was a non-credit card purchase it would be dealt with by their retailer dusputes Section 75 team. Researching this legislation shows that cash payments are not covered, so appears I am at a loss.

Is my only port of call to send the bumper back, let the person who made the mistake make money off the back of it, and leave me £150 out of pocket for the cost of spraying something I no longer have?

Welcome any help
Adam
