ESA Claim Closed

I am asking on behalf of my brother. He was claiming ESA, he got sent a form (Limited Capacity to Work), unfortunately he sent it back 3 days late. He has phoned them today and was told that they have closed his claim and that they have a 3 week back log of claims. What should he do? Can he open another claim for ESA (he has a sick note) or should he claim for JSA? Any help is much appreciated.

The DWP are required to ask him why the ESA50 was late, he needs to show Good Cause. He can make a new claim, but as his previous claim was failed due to a technical infringement, he will not be paid anything until a decision on this second claim is made, so he needs to push the DWP to re-activate his original claim. Tell him to escalate it to the Customer Services manager.0

When it comes down to the DWP, you have to be prompt with whatever they are asking you to send back, as in your brothers case they didn`t even give him a bit of room to move, but hope ur bro sorts it soon.:j0

Perhaps it is a valid reason, and you just dont realise it.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
