Winnings and seperated wife

Wife and i have been separated for nearly 3 years. She refuse to give me her address so i can serve divorce papers.

I have custody of our 3 children. She comes once a week to see them.

I sometimes do the lottery or phone in to daytime TV shows for the prizes.

Just wondering what rights she has to any winnings i receive?

I have been told i cannot fill a certain form which stops her having any rights to my savings. That form can only be completed as part of divorce procedure
Problem with having access to internet is that i get asked by many to solve their problems :( Well at least i learn something on the way :D

    wazza love your enthuisam!! i hope you do win something, but be careful with those daytime TV shows the cost a fortune :eek:

    I think as long as she is still your wife she can still have a claim on your winnings.

    Yes she would be entitled to a share of any winnings although obviously all the circumstances would be taken into account.

    There are companies that offer tracing services on a no find, no fee basis and are not very expensive.

    Do you really need her address to divorce her? I have no idea about these things, but that sounds plain silly if it's the case!

  • no they can serve them anywhere .. work an address they know she would be at .. get them served while shes at yours .. thats stupid cant divorce her coz no addresss :(
  • Can you not divorce her as you have been separated for longer than 2 years? When you apply to get divorced you sign something called "A clean order break" this means that you are not entitled to any monies she receives after the divorce and likewise for yourself. ie, winnings on lottery, inheritance etc....HTH

    Until you are divorced and all finances settled legally, she can claim half of whatever you have now or might get in the future.

    Mind you, if she wins a lottery, then you can claim half of it, as well.:j

    If you wife does not consent, divorce cannot proceed until after 5 years of separation. After 5 years, it cannot be contested and you do not have to have her address either. Up until then, she is still your legal spouse and can still benefit financially.

    That is not strictly accurate as there is always desertion, behaviour or adultery to consider.

    An address for service of the petition is needed, but as stated this does not have to be her residential address. Not sure it is advisable to have the petiton served during contact as this will impact on the children but if it is the only way, perhaps having her served as she leaves contact would be the best course of action. That will not come cheaply though.
