Refund refused by Marks and Spencer

I bought some pyjamas for my 11 year old daughter a couple of weeks ago and after one nights wear she spotted a very neat triangle cut out of the bottoms (at the back - which is probably why we didn't notice to start with). After a bit of thought we decided that even a 4 year old with very sharp scissors couldn't have cut this so neatly and neither could it have happened by accident any other way. (Try cutting a perfect triangle out of the middle of any material with scissors!)
I took it back and the assistant agreed but called her manager who said no it wasn't a manufacturing fault but she could send them away to be inspected. They've come back today and they've agreed with the manager.
What do I do now? I don't call them 'fit for purpose' but don't feel confident enough to argue my case. If we had one near by I'd try another store.

So what are they saying is the reason for the missing bit of material? Even if it didn't happen during manufacture doesn't mean that it didn't happen before they were sold. Are they saying that you/your daughter must have done it? TBH, it's a difficult one. The onus is on them to literally prove that you did this, something that they really can't do. But can you be bothered to have the battle? I'm surprised they didn't just exchange them anyway. M&S are usually quite good at this sort of thing. Did you insist on a refund?

Not my experience with M&S.
They are usually one of the better stores. I had a blouse not that long ago that split by the stitching in a couple of places after it was washed.
They took one look and could not stop saying how sorry they were. I was given a full refund, there and then.
You will have to try another branch, or write to head office.0 -
I agree with fluffnutter. Find out why they say they won't take them back - i.e. what do they think might have happened.
Then (assuming that they're wrong!) take it to head office.0
