Can I have P&P refunded?

Pair of shoes, P&P was £9.50, I asked for it to be lowered, seller took off £3 so I bid and won. The shoes only went for 99p. Total payment, £7.49. Shoes listed as size 6.5, actually UK 5. I know I'm jumping the gun, but seller's feedback says "does not answer emails". If this is the case, should I apply to PayPal for refund, and as it was "not as described", can I expect the P&P to be refunded?

My own personal experience is that you will get the total amount back - £7.49, but that you will have to pay the return postage yourself if you raise a paypal dispute.

Having said that someone else said that paypal also paid them out the return postage....

Anyone got a definitive answer?

I'm really not sure what Paypal's view would be as to whether listing US instead of UK sizes (and letting the buyer assume that the size given is UK) entitles the buyer to a "not as described" refund. If it does, you'd still have to return the shoes at your own expense. I'd try contacting the seller explaining the problem, since listing the US instead of UK size is clearly a mistake.

The listing was one sentence long, and in both title and description said UK 6.5. Nowhere was there any mention of US sizing. On the sole of the shoe is clearly etched 37 1/2. Only the top was photographed. As I had resignedly thought, the seller has not responded to emails. Thanks very much indeed for your helpful response though!
