Bank charges / financial hardship

Options
Hi,
I started a debt management plan three years ago. Part of the reason for this was because of overlending resulting in charges/interest etc.
These charges were obviously stopped when I entered the debt management plan with CCCS.
Can I claim? And if so how long can I claim back for (I have bank statements going back to Nov 2002.

What would be your reason for complaint? (and dont say unfair charges as they are not)

Also, was any money written off as part of the agreement? If so, then even if they do agree to refund some charges, they can offset it against money they have written off first, then arrears and then only if there is surplus, would you get it. However, that is jumping the gun as refunds on these types of charges are not common.

  • One specific complaint would be that a £3 donation to charity would have took me £1 overdrawnand instead they rejected the direct debit charging me £28 and then a further £38 for going overdrawn.
No money was written off as part of the agreementand I do understand that anything would be written off first.

A)I was also unsure to whether the £38 charge would be deemed to be too high? I was paying £10 a month to use the account but they said that this could not be stopped until the account was out of arrears which never actually happened.

What is wrong with that? (i get the amounts are not great for going over your limit but if you had already had problems on your account at that point, they were probably operating a strict limit). In respect of the amount, the banks won the court case and you cannot complain the charges are unfair. The FOS dont take on complaints about unfair bank charges any more.

  • I was unsure on my position due to financial hardship (DMP). Thanks for clearing it up.
