MBNA Credit Card PPI Claim Rejected

Hi,
I'm new to all this to please be gentle! :-)
I put in a claim to MBNA and have been told that my claim has been rejected due to me applying for it online, problem is I did apply for it online but I can't remember ticking any box for PPI and I only realised I actually had it when I was made redundant and was looking through my documents.
When I realised I was paying for it I tried to make a claim but was unable to (can't remember the reason why), so cancelled it straight away because I thought if I can't make a claim it is useless!

Anyway I put my claim in and they have now rejected it as I apparently ticked this box, which I don't think I did!

Do you think it is worth going through the financial ombudsman to try through them?

  • Yep, take your complaint to the FOS - the same thing happened to me with one of my MBNA cards. As I had applied online etc etc...however, I wrote to FOS, explained that I was a civil servant with six months full/six months half pay and would never have been able to claim on the PPI. MBNA then came back with an offer within about six weeks. It all depends on your circumstances - whether the PPI could ever have been claimed upon...

    Write back to them and tell them you reject the reason for them not upholding your claim,put that they cannot use the "you ticked the box" as a reason for not upholding,also tell them the fact it was useless to you as you tried to claim on it and it did not cover you,makes this is a good reason for mis sell.
    Put that if they do not reconsider your claim with this additional info,you will take this to FOS to deal with..

    All these points are likely to emerge for me when MBNA respond to my claim. Thank you for the encouragement to persevere.

    It is whether or not you were in a position to make an informed decision to purchase.

    If the information was available to you before you ticked the box in a way that was clear, fair and not misleading and you ticked to opt in (as opposed to having to tick to opt out) then you have mispurchased but you were not missold to.

    I agree with your post 100%.
    If the op took the credit card before july 06,the chances are the box was pre ticked.
    The op also tried to make a claim on the insurance and was refused,this seems a good reason for mis sell?,as it did not cover them.
    I was suggesting they take this further because of the insurance not paying out and also the box may have been pre ticked.

    If your previous claim for assistance has also been rejected, as stated above, this gives further evidence the product was unsuitable.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

  • Thanks for the advice, got my letter from MBNA now and letter ready to send off to FOS so fingers crossed I will get somewhere with them.

    On the up side my partner has just had 3 claims upheld with welcome finance so happy days :beer:

    Hi mate
    I recently received a generic reply from MBNA claiming that I ticked my online application on 20 April 2006. Also claiming that this was their final decision.

    What do I do now? Should I approach the ombudsman or should I go back to MBNA claiming that the cover was missold indeed as this option was clearly preticked. Implying that this cover was necessary and therefore a pre-requisite to apply for the credit card.

    I am confused as the general msgs relating to this (MBNA rejection) usually advise to
    a) Challenge MBNA on their decision or
    b) Go to the ombudsman for this

    I've had the credit card with Virgin/MBNA from 2006 thru to 2009. I know I have paid a fairly substantial amount in PPI. I have never made any claim, never had to.

    Also, I do not have a copy of the the PPI Application I sent to MBNA. Can I request this back?

    Any advise appreciated.
