GAME - Help needed with a Playstation issue.

Hello all, just found this site in a time of need and I hope one of you might be able to help me.

On 22/08/2008 I bought a Playstation 3: 80gb from GAME for 299.99 which has stopped working.

The problem is that is just stopped working and will now not turn back on. This has occured without any damages on my part and I have had no faults with it before.

I wouldn't normally fuss about this but I don't believe that three years is long enough for something that was that expensive. And with me being a university student I can't really afford to pay for repairs or a new one.

I think I found something that would help me which was

'The Sale of Goods Act 1979 (as amended) states that when a consumer buys goods from a trader they must be: as described; of a satisfactory quality; and fit for any purpose made known at the time of sale to the seller.

This legislation also states that the seller, not the manufacturer, is legally obliged to sort out a problem if the goods do not meet these requirements.

The law also says I have six years from the date of purchase to claim damages for faulty goods.'

Yet when I emailed GAME, they just keep sending me the same automated reply saying that they think three years is satisfactory. Can anybody help me as I'm not sure where I stand.

    Sale of goods act says up to six years to make a claim.
    It does not say that everything should last six years.

    Have a read of MSE's excellent Consumer Rights article for further detail.

    The Sale of goods act states that you have UP TO six years. The actual length of time can be defined by the type of product, the price you paid etc. For example you would expect a £1000 microwave to last longer than a £10 one.

    If you wish to claim under the SOGA you would firstly need an independent report from a qualified engineer who would be happy to stand up in court and claim that it is an inherent fault or manufacturing defect. You would also need to make a good case that the product should be expected to last more than 3 years. If "game" are quoting that 3 years is reasonable i would presume that they have experience and that 3 years is seen by trading standards etc. that 3 years is the time on that particular item.

    So as a summary if you want game to repair it you would need to do the following

    1/. Prove that it should last more than 3 years, the law states that an item can last up to 6 years not that it has to!

    2/. get an independent report to state that it is a manufacturing defect.
