Pre-ticked PPI with Capital One

Hello I wonder if anyone has any experience of Internet Based applications for CAPITAL ONE. I recently wrote to them asking for my PPI back. They proceeded to send me a screenshot of a ticked application box from 2001. And said GO AWAY, you ticked it.
I read that some lenders had this box pre-ticked. And it was only in 2007
In July 07, all lenders agreed to stop doing this.
Anyone had any experience of online capital one applications? Should I challenge them for proof that this box was not pre-ticked?

I suppose if it was preticked there was probably the option to 'untick' the box.make the most of it, we are only here for the weekend.

About to challenge Capital One PPI as well.
The box for PPI was ticked but due to pre existing medical conditions the PPI was useless.
Due to have abit of a tassle with them me thinks but will still persue it though and will see what transpires in due course.
Not sure what to do though about the Credit card agreement they have sent for someone else in with my paperwork. Any suggestions ?

If the box was preticked, or you had to tick to opt out then your chance of an uphold is good.
If it was not then it is less so for obvious reasons.
It can still be upheld if you did not qualify for the benefits and that was not reasonably apparent.0
