    Well, if it's definitely not "sole selling rights", then you won't have to pay a fee to them.

    I'm sure the buyer won't mind saying that she found the property on Gumtree and has never been in the area, therefore could not have seen the sign.

    As others advised, you need to get a solicitor to have a look at the contract, or post the exact wording on here and I'm sure someone more experienced will be able to help. My thoughts are tell him to shove it ! but don't know if legal or not.

    If this Gumtree buyer does end up liking your house, who will she make her offer to? You or your agent?

    Will you expect the agent to progress the sale after the offer is received? Why should they do that, if you're not going to pay them?

    Have you hired your own solicitor?

    You don't need the agent once you accept the offer. The solicitor can handle all the rest. Make sure the buyer has no contact with the agent and tell them to go whistle for their money.
