ebay, faulty item return

Hi, i purchased a rc plane for my son 17th dec as a xmas pressie that turned out to be faulty, I contact the seller who then offers either repair or replacement lol i opted for a replacement, i then post item back, a little confused as to why ive heard nothing or recieved a replacement. After lengthy amount of mails he replies the item is now with the supplier who will from this point on deal with the matter, i ask for the suppliers details and commence in contacting him. He is to say very bewildered as to why im calling him as although the item was now with him he does not send out replacements and the contract was between myself and the seller. Now after numerous emails i still get no response from this seller, so it seems i have a seller who,s telling me the supplier will deal with it and a supplier who,s telling me its the sellers responsibility which i personally thought was correct. Any advice would be appreciated. thx

    Hope you returned it tracked and have proof of delivery.
    Open a Paypal case as SNAD (stick to paypal all the way don't get diverted to Ebay) upload proof of delivery,paypal will examine claim and should refund you full purchase price and original p&p

    Under the Sale of Goods Act your contract (the purchase) is with the seller. If the seller wishes to return the item to the manufacturer then that's up to him, but no concern of yours.

    If this is an Ebay sale then you need to look at opening a dispute within 45 days of the date of sale so will need to do that soon. As many on here will say open the dispute via Paypal if that's how you paid. Others will be along soon to add further advice.
  • As i was sitting here stewing thinking about this seller i try the contact number for his supplier, lol not pleased to hear from me again. This time he states the said item had a defect that could not otherwise have been caused from new ,thing is i have extensive knowledge of this type and knew exactly what was wrong with it, at this point no longer able to hold it i lose my rag and tell this erm man exactly what the problem was along with some choice words, expecting a hang up i get a ,,we dont normaly but on this occasion will er replace the item,, :) first time im come across sellers of this rankness and i hope its the last time, but at least now i can tell my son his long awaited xmas pressie is eventually coming. cheers

    You are not making things easy for yourself.

    Did you return it tracked? If you did, then forget phone calls and open a dispute. When prompted add the tracking and you will get your refund.

    If you didn't, then you are at the mercy of the seller. Do you trust this new promise?

  • The item in question was not tracked on return, dumb i know but after my convo yesterday with the er supplier i recieved the item this morning:) i think ill consider myself fortunate on this one and have learnt a few lessons here. thx

  • Yes i know i was very lucky this time certainly wont make that mistake again, i dont know why he done a 360? i did at least have his location, turned out wasnt that far from here i mean if i was gonna be blatantly ripped the least i could do was say hello, anyway guy stuck to his grunt and sent it out, just glad its sorted.
