Sales of Goods actually allows you to reject goods for a refund if a remedy is not provided within 'reasonable' time. You wouldn't receive a full refund though, it would be reduced to take into consideration the use you have had.
If rejecting it though, knowng it is Comet, don't expect it to be easy or quick.0 -
I'll mention as no-one else has yet. Whatever remedy the retailer provides, under the SOGA they must not cause a significant inconvenience. I know doing without a TV isn't the end of the world for some, but being without one for this length of time could well be seen as such an inconvenience. Personally, I'd be reminding Comet of their statutory duty to provide a remedy in good time. Having said that, if they still don't play ball there's not much more you can do other than starting legal proceedings, starting with a letter before action.
Significant inconvenience has nothing to do with it. Reasonable time frame however does have everything to do with it in this case.0 -

Regardless of what people think a TV is a luxury item and I cannot ever consider being without one a significant inconvenience, a inconvenience yes, but not a significant one. That said, if the OP had to take a week off work for failed repairs, I'd consider that pretty significant.
As it stands, It's nearly the Reasonable Time Frame that applies.0 -
I am shocked to read all the posts about comet!! I have always purchased my electrical goods from them but never again! I bought a beko tumble drier from comet, 5 months ago. I wasn't concerned about the brand, just one that was in stock, as my tumble drier had broken down that morning and as my youngest child is disabled, it is a necessity!! The tumble drier broke down a month ago now and I am still waiting on a repair. An engineer came out two weeks after we had made the report and left telling us he had to order a part. We have called twice since, on their 10p a minute telephone line but are no further forward. I asked to make a complaint but was told I couldn't and was told, rudely, that they comply with the SoGA!!!!! Not sure what to do now out of pocket, laundrette and phone calls, but still no sign of repair?0

I rencently discovered that one of the hdmi ports on my 3D TV was not working properly, contacted comet and they arranged collection for repair. The TV came back to me after two weeks but upon hooking it all back up I noticed that the screen had been damaged and the frame of the TV chipped and scuffed.
It has since been collected again but the repair centre are being very unhelpful and not answering any of my questions regarding refund or replacement.
Where do I stand seeing how this damage was caused by the repair centre?
Have now been without a TV for three weeks. Comet themselves have done all they can in their opinion but say that it's all down to their repair centre to resolve the problem but when I call them they get quite rude and abrupt. Surely they should be going out of their way to sort it seeing how they damaged it?!?!?0
