  • Unfortunately AFAIK section 75 does not usually apply here, its normally chargeback.

  • Make a formal complaint to H.M. Courts and Tribunals Service which is part of the Ministry of Justice about the way your case was handled. They should be able to help you put things right or, at the very least, sort out the mess their employees made and losses they caused.

    As regards claiming against the clamping firm, the claim is still within the six-year claim period - you have until 2014, after which it will become time-barred.

    Alternatively, have you considered laying an information before a magistrates court and having warrants issued for the clampers' arrest?

    Give it some thought. You certainly have a case under the Criminal Law from what you say in your posting.

    OK, update!

    I have issued a formal complaint with support from my MP to the court. They responded with the same thing - I have to pay £80 to appeal to have the case reopened. I am going to go forward with the complaint now to the county court ombudsman. My MP is happy to support me with that too.

    Bluelight, how do I go about what you mention the third paragraph. I have resigned myself now to the fact that Willesden County Court are not going to help me, yet I am still wanting to continue the fight against Parking Control Management for my £240 clamp fee and associated costs.

    I go through phases of losing the will to live with this thing. It's been going on so long and I am sick to death of it. I am just so sure I will get it back. *must stay patient and keep going*

    Go to some other County Court. You can choose any you please. It may be cheaper/easier to re-start the claim from scratch, but this time make sure you include the owner of the car park as a defendant- claiming from a clamping firm is often a waste of time as if you win it can be impossible to enforce!
