Sold car and posted V5 question

What would happen in this situation?

Sold car that is SORN and have told the buyer it will need to go on trailer. Someone comes and buys it we fill out the V5 form and I post it same day. New owner drives it that day before DVLA have received forms and gets caught driving it with no tax.

Who is responsible? Me still or new owner?
It's only a bargain if you need it.

    The driver is responsible.
He can clearly see that there is no tax disc displayed for a start.
And if he didn't spot that, you told him too.

Your timed and dated receipt will be further proof that the driver is in fact the new owner.

A timed and dated receipt is always a good idea... you never know how many speeding tickets you might pick up having just sold a car. :D

Sorn is only valid for the owner at the time. The sale cancels the sorn notification.
Even though it still shows on the dvla database, it's down to them, not you.
It would be easier for the buyer to tax it, and drive it away.
  • if he was stopped then it'll be a named ticket with his details on it. no come back to you as long as you make sure you get an acknowledgement letter from DVLA to confirm you sold it.

Unless they give the current owners details? They will lose the car but probably get away without paying a fine and getting points.

You get the hassle of convincing them it was not you.

    But thats the worse case.

You've not been tugged by the police have you.

Trust me when I say they are thorough, very thorough. I bought a car a few years back and had arranged insurance over the phone the same day. It doesn't show on the MID for about 24 hours so as you can imagine on my way home I got tugged.

Trust me, there is no way you would get away with giving someone elses details unless you know their place of birth, date of birth, address history, previous arrests, parents, etc.

Not for many years, Where some snotty policewoman swore blind she knew me, This was the pre computer age
so the policeman radio'd through my details.

She then started looking around my car and commented on some damage that had been done when it was
stolen. Saying thats not safe is it.

She went quiet when i said, It was stolen at 5pm yesterday, And i got a knock on the door before 6am saying they
found it and would i like it back.
Luckily it was still drivable, onle minor damage. She went quiet when i asked if she had found who did it yet.

Obviously they need to pay to get that damage fixed.

Well trust me, I got tugged a couple of years back and there wasn't any stone left unturned. I think being probed by aliens would of been less hassle.
