Taking advantage of poor product labelling...

First time thread, long time lurker, never posted...

So I just bought a new Creative 620headset from Argos because I had a £30 gift card lying around that was about to expire, and I had lost my mic for my Fatal1ty headset



Now the item is described as a Creative 620 USB headset. The headset is however not USB at all. I bought the item not bothering to read much of the product description, quickly googled the product number to look at star ratings of reviews, reserved it and picked it up from the shop having never noticed that the connectors are in fact 2X3.5mm jacks.

I'm aware that I could take the item back and get a refund, but I don't have more than £35 for a new headset, and I am quite happy with the quality of the headsets sound. What I'm wondering is could I take advantage of this poorly labelled product to maybe blag a USB soundcard out of Argos, or get a partial refund and keep the product?

  • Argos are not very good with their descriptions. I urgently needed an ADSL router for a job that day and looked on their website and found the one I wanted. What's more, it was in stock in my town so got the box, went to install it and it was a cable router only. Loads of messing around ensued and had to spend plenty of time explaining the difference between a cable router and an ASDL router before I got the refund.

    Legally, if you return the goods quickly and as soon as practical, then you won't be deemed to have accepted them and (because the item is not fit for the purpose for which it was sold - i.e. cannot be used as a USB headset) you are entitled to return it for a refund. Or, of course, you could keep it.

    You could try to "blag it", just like I could go in to a supermarket and offer them a penny for a banana. They might agree, but I very much doubt it. A company like Argos will have tight margins and won't have much to gain by handing out freebies. A "prestgious" company (e.g. Rolex, Aston Martin, etc.) would be much more likely to "butter you up" in the hope that you'll recommend the brand or spend more in future, but Argos isn't really based on that kind of business model.

    you can raise the trade descriptions act 1968, but to be honest you would only get about £5/10 good will, ussually works if you live out of town and its taken time and effort to get it returned due to it being falsely advertised.

    I thought the Fatal1ty headset has two 3.5 mm jacks, mine does and so my Fatal1ty Sound Card that I connect it to.

    Are you saying that your soundcard doesn't have the standard 3.5mm mic and headset jacks?

    Argos sold me a Kindle and leather cover. Turned out the leather cover was for the other model Kindle. They obviously have little idea of what they are selling, but getting a refund was quite straightforward.

    Yes the title does say USB, however the description does clearly say 3.5mm jack connection, so not much can be done.

    No he said he thought it had a USB plug & it had 3.5mm plugs, he said nothing about a sound card.

    I think you miss my point.

    I have a Fatal1ty headset and it 3.5mm jacks on it, not a USB plug. I suspect his does to which means the headset from Argos will simply plug in to the mic and headset sockets on his PC. Hence my comments about his sound card.

    How many PCs have you seen that don't have a 3.5mm socket for headphones and speaker.

    In his post he even says he's happy with the quality of the headset's sound so it obviously works.

    Having got it home and found the mistake in describing the headset he's wondering if he's due to any compensation. He's trying to, in his own words, 'blag something or get a partial refund and keep the product'.

    As others have said the best he can expect is a refund.
