2nd Laptop - fir for purpose?

Hi all,
Just a quick question as I have to go hash it out with the shop owner in 30mins.
I bought a second hand Laptop the other day from a local shop and noticed that after a couple of hours the screen started flickering.
I took it back and the owner says that its because the battery is overheating and its not the kind of laptop that you can have on a lap...Mmmmm what now?!
Anyway (a) I don' think over heating is the issue, but as its intermittent I can't show it happening and (or so) (b) I don't think its fit for purpose.
Can anyone give me some quick tips before I go argue the point? Can I just stand tall, pump my chest out and demand my money back?
