Beware of Ebuyer T&Cs

Ordered a Philips Freeview Recorder from Ebuyer. Ebuyer stated that it was a 'Grade A' unit. When I recieved the unit it was obviously very second hand being badly scratched, cables untied,batteries loose etc. I rang Ebuyer Customer Services to say that I had been sent a 2nd hand item only to be told (by a very 'snappy' woman) that it was a 'Grade A' item. I said that I thought that 'Grade A' would have been the best. She then said that I should have read their T&Cs as it clearly states that Grade A items are second hand or returns. I did find it in their T&Cs, under section 10.2. How many people read that far into T&Cs??
They said that they would refund my money (including P&P) as they agreed that it was not only 2nd hand but also faulty. I would now like to quote their own T&Cs to Ebuyer as it states in their T&Cs sections 9.1, 9.1.2 and 9.1.3 that they will refund P&P for returned items that are found faulty. I only received the cost of the item, not including P&P.
So because it was my fault for not spending half an hour reading their T&Cs it has cost me over £17 for receiving and returning a faulty item.
Thank you Ebuyer for your lousy Customer Service I shall not be buying off you again!!!!!
P.S. Please STOP sending me emails advertising your 'great offers' I'd rather go to a car boot sale.

    I fear you will get mixed reactions here.

    There is a small group of RWA's who believe that everybody should read every word of every T & C before doing anything.

    In this case, however, they may have a point because there is no accepted definition of 'grade A'. It varies from supplier to supplier (although calling something that is badly scratched 'Grade A' is rather taking the P). I would always check a particular supplier's definition before ordering 'GradeA' or 'Grade B' stock.

    I had never come across Grade A, B, whatever, before this so I assumed that it would be a new item. I know that I will get slated by the 'holier than thou' people for not spending half my day reading T&Cs but for goodness sake if you go into a high street shop you don't read their T&Cs before you buy an item!!

    Mail them for the return P&P costs and quote their T&Cs. If they don't pay up, you can escalate via the small claims court. Once you quote their T&Cs to them, they might pay up (they did for me).

    Yes, I hadn't thought of doing that. Throw their own T&Cs back at them. I like it!

    If an item is marked as anything but new, you should check the company's own grading system.
