Thanks All, We havent got the money to be able to afford to pay for the 2 months as well as paying for somewhere else to stay / move to otherwise we would do that!

Make sure that you get the proper sponge ones. The other kind can be uncomfortable to wear for hours on end. They will make a huge difference to you attitude and mood once you've managed to get a good night's sleep and are less exhausted. Honestly, you have my sympathy. Noisy neighbours can make it a living hell.0

I'd go for the wax / silicone ear plugs every time. They are not as comfy as the foam ones, but they keep out the noise so much better!0

And keep on at the council. She shouldn't be allowed to carry on like this and the threat of an ASBO might be enough0

You reckon? In my limited experience those who don't give a flying eff about their neighbours, and ignore or insult those who challenge their behaviour and ignore their landlord very rarely take any notice of ASBOs. It's only when their behaviour actually starts impinging on their own lifestyles or housing options that they start to sit up and take notice. Even then, the least intelligent of them still insist it's everyone else who's unreasonable. *rant*0

Perhaps OP should play really loud music during the day as if the neighbour is having all night raves then she is going to be sleeping through the day (EVIL Laugh). Obviously I don't suggest you do this but it would be so tempting if it was me.0

Does anyone have any advise on what they would do in our situation?
Lots of my friends are saying just leave and send him a letter stating with immediate effect we are moving out due to the noise? However my partner thinks we should try and stick it out for the 2 months?

What we have done is this: we have just put our flat on the market to move out of a hell of noise from 1 AM to 5 AM caused by the upstairs tenants of another landlady. This is the only property we own. Many owners sell for the same reason. Google the issue.
Your LL has no obligation to make your flat less noisy. The next door LL has no contractual agreement with you and no obligation to you. The tenants do not have the rights stated in the leases applying to other lessees. Your LL may serve a notice to the LL next door for breach of lease but this aggravates the relationship between the two of them. Some leases do not have adequate enforcement clauses or may be none.Only adequate soundproofing deals with noise but it costs and may not be covered by insurance always. Carpeting is inefficient.
Even landlords in same block cannot deal with noise nuisance from another landlord. New laws are required to deal with this huge problem.
LAs say the noise indicates “a gap between lifestyles” and they do not take sides. You really waste your time and earnings from work staying in that noise.
What you need to do (must) is this: every time there is noise phone the LA and ask them to log it. Keep a log yourself. What we have done was to tell our MP that noise needs to be dealt effectively with new Law making. You may wish to see you MP"I'll be back."0
