Paking ticket appeal.

Options
I parked just outside richmond park on a Sunday. No lines/markings on the side of road and i have parked there on numerous occasions before. Contravention was: PARKED WITH ONE OR MORE WHEELS ON OR OVER FOOTPATH OR ANY PART OF A ROAD OTHER THAN A CARRIAGEWAY.

I parked up on the curb as that was what all the other cars had done on that stretch of the road (i was not alone) and it was more considerate to passing traffic on the road. I had not blocked the path either. To further emphasise my point, my wing mirror had been knocked back so had i not parked up on curb it would have been even more dangerous.

Please could someone let me know if there are grounds to appeal as this seems completely unfair to me.

Further, on my PCN they mention the charge will be reduced by 50% if i pay within 14 days and i can see that they should have put the sum but it is missing. Is this ground to appeal too?

This sounds like a council PCN so don't ignore it. Get across to www.pepipoo.com and post details there on their council parking forum. If someone asks for information make sure you provide it to receive the maximum assistance.

    Show us the paperwork.

What other people did and whether or not you blocked the pavement are generally seen as irrelevant in such cases.
  • Date served: 15/01/12

Seen in Priory Lane, SW15 OPP NO 142

    From: blank To/At 12.42

Date of contravention 15/01/12 by civil enforcement officer 1396

Grounds of parking contravention: PARKED WITH ONE OR MORE WHEELS ON OR OVER A FOOTPATH OR ANY PART OF A ROAD OTHER THAN CARRIAGEWAY

    Wandsworth Borough Council.

This is all the information provided on the ticket. Is anyone able to help? It seems seems absurd that i can get a ticket when i was trying to be considerate of passing traffic. Normally cars park on the road without going on the curb but that day everyone had parked up on curb so i followed. Had i not i would have been sticking out a a a lot!

London Boroughs you cant park on a kerb unless it says you can! You need to post the actual PCN up over on http://forums.pepipoo.com/index.php?showforum=30 hopefully there will be a flaw in the paper work!

Not what you want to hear, but I am glad you got a ticket. I would imagine all the other cars parked on the pavement got a deserved ticket too and I hope lots more are given out.

It is very simple and in the Highway code: http://www.direct.gov.uk/en/TravelAndTransport/Highwaycode/DG_069860?CID=TAT&PLA=url_mon&CRE=highwaycode_parking
You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking on the pavement can obstruct and seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams or pushchairs.

If you feel you have to park on the pavement to allow cars to safely pass, don't park there: It is also an offence to block the carriageway, regardless of road markings.

It isn't as if there aren't any car parks in Richmond for you to use. Just imagine pushing a double buggy or making your way along the pavement when you are blind. It is almost impossible in that area with all the cars on the pavements. It doesn't matter if you think there was enough room for a pedestrian to squeeze past, or that other cars were parked that way, it is still illegal and inconsiderate.

What is more dangerous: your wing mirror being knocked back or someone in a wheelchair having to go into the road to navigate around your car?

Just pay the fine and next time do something radical such as parking in one of the car parks that are designed for the purpose.

Sorry, but if you parked on the pavement and still got your wing mirror knocked you weren't being considerate to other motorists. If you wanted to be considerate you would have driven around a bit longer and found a car park or a wider street where you could have parked safely.

No it is not, not at all! ;)

Pepipoo will need to see a photo of the front & back, all the small print, everything except the car reg and PCN number which you should cover when taking the pics. Read a few threads there to get the gist and you will see you need pictures. Read the FAQs and register and post a new topic here:

Good luck. Not everyone is so critical on here, nor on pepipoo. There are plenty of streets where you can park with wheels on the pavement (my own road outside included; my own car has 2 wheels on the pavement right now). Only difference is you were in London which has a ban on pavement parking unless signs specifically allow it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
