JSA - not enough Class 1 National Insurance Contributions

  • I am being given contradictory advice re my current contribution-based JSA claim which was disallowed in 2014 based on NI paid in tax years 2011 and 2012. Due to a new Benefit Year starting in January 2015 they can use different tax years so one advisor told me end my claim and make a rapid re-claim but another advised me not to and seek advice from the Job Centre. I just seek clear non-contradictory advice!

[Bthe relevant benefit years are now 12/13 and 13/14.
did you pay NI during both of those tax years?
bit concerned about the rapid reclaim as that would link to the last claim ... the claim where you had no entitlement.
im not sure though. someone will be along that can tell you for sure[/B]

You need to start your own thread....hijacking 3 year old posts can complicate issues.

It seems this is still a problem for claimants.
Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

You would end your current JSA claim,
Wait 13 weeks (it's actually 12 weeks but 13 to be sure)
THEN make a new claim to JSA which WOULD be a Rapid Reclaim because a Rapid Reclaim happens within 26 weeks but does not necessarily link the claims.

It's not wrong, unless we've been told incorrect info by two different advisers.

And for the record, seeing as you did not return to the thread.

What you wrote WAS wrong, and the two advisors were either wrong OR you misunderstood what they were saying.

    This is wrong

It is based on your NI-able (EMPLOYED NOT SELF EMPLOYED) earnings during the 2 relevant tax years (currently 2010/2011 &2011/2012) NOT the number of weeks you contributed.

is using ballpark figures approx £5,400 it's not the actual figure I can't be bothered to work out the exact figures but if you earned around this much employed then you definately need to have things looked at closer by a decision maker.

Your JSA claim in 10/11 would not be the reason for the disallowance, if anything that would help your new claim because each week you were on JSA would count as approx £100 NI able earnings.

Are you sure as as far as I know any NI credits accrued whilst on JSA only counts towards the state pension not for other cont based benefits in the future - only NIC taken from a wage goes towards that.

    Quite sure.

Benefit NI Credits do not go all the way towards Entitlement for Conts based benefits, but they do go a long way towards entitlement.

Benefits that count towards other Conts based Benefits include
JSA, ESA, CA, IB.... and I think IS (but not sure on IS)

And Child Benefit NI Credits do not count at all towards Conts based benefits
