  • To be honest, I don't think Tesco have done too much wrong.

    You gave them all your details including bank details - it'd be naive to assume they were just for checking purposes.

    Just to check a couple of things:

    Was this is SIM only deal, or was there a handset sold as well?

    Does your friend still have the SIM and handset?

    Have you asked TESCO Mobile to block the SIM and blacklist handset to prevent use and running up calls on your bill (both of tehse should be done - SIM block to stop call charges and handset balcklisted to prevent use with a different SIM, or your friend selling the phone on)?

    Sounds like your "friend" has tucked you up. How do you know that the salesman was real and not just her boyfriend? It's not too hard to knock up some fake documents for identity theft, which is what has probably happened. Contact your bank and explain that there are fraudulant transactions on your account.

    An employee of Tesco has lied to the OP. In what sense is that not doing too much wrong?

    Why is it naive to believe a Tesco employee who states - twice - that the details will not be used to set up a contract? Should we believe all Tesco employees are pathological liars?

    I would be very surprised that the employee would like "like that" to get a sale. Even though the Mobile industry is cut-throat, I don't think it's *that* cut-throat...

    However, it sounds a lot more likely that your "friend" got someone to pretend to be in the store and ask for your details.

    Without signed paperwork, they have no chance of enforcing the contract - however I think they WILL have a signed contract, from your "friend" pretending to be you.

  • Been in touch with Ofcom have a letter from them saying that if they cannot provide a copy of the contract we have been mis-sold.

    Still trying to sort through the store but will take them to court if get no response by Monday.

    Have you contacted them in writing? (Letter sent recorded delivery). If not then court action may well fail as you'll struggle to prove you gave them reasonable opportunity to respond to / remedy the issue.

    (It's only 4 days since your first post, which doesn't say when you raised this with Tesco).
