Nintendo 3DS problem - from Currys- Advice needed

My daughter received a brand new 3DSon Xmas Day, bought from Currys the week before Xmas. The joystick on it is not operating correctly on certain games, i.e MarioKart 3DS.

Obviously I have the full guarantee and receipt, so if I take it back, am I within my rights to ask for a replacement from them?

    On the face of it, sounds like a faulty game to me.

    The game itself can't be faulty in that way....if it works but the steering is faulty. MK7 is one of the best games ever, and isn't coded in such a shoddy way.

    Could be that MK calls for more sensitivity on the joystick, so its altogether plausible that a fault would show up on some games and not others.

    Our earlier poster clearly likes the game in question and refuses to believe that anyone could possibly consider that a fault could exist in it. ;)

    I had a game on the Snes (Mario All Stars), which showed a very specific fault up on my Snes - in the second game the character falling from the sky would loop endlessly.
    It didn't show the problem with other games that I noticed (I suspect it may have resulted in other games crashing, and been a memory address that wasn't used much).

    It took me about 30-45 minutes in the store, arguing politely with a member of staff who would go from the display console to our one trying the same bit over and over again before he conceded it was a faulty console (you would have thought after the second go on both it would have been obvious, I think he tried it about 10 times on both).

    So it's entirely possible for a game to display a fairly obvious fault on one console but not another, as not all games require the console hardware to work in the same way, thus something like a dodgy memory address, or joystick that isn't quite up to scratch can easily not be noticed until a particular game tries to make use of it.

    It's one of the reasons that a fairly basic trouble shooting method for unexplained crashes on PC's is to run a proper memory test :)

    I guess if your daughter has got a friend with a 3DS you could try your game in their console to see if it does the same. If it plays differently then you'll know for sure if it is your daughter's 3DS that's the problem.

    You have 21 days to return and get a replacement or refund, so take it back to the store. They might want to test, so do bring a game you can show them for.

    If you get a new one and it does the same, then it may be the game.
