Renting a flat, washing machine broke...

    If the repair drags out over the course of a few weeks and the bills for washing add up, then he may say something, but for the time being hes gonna see how things go, thanks for the advice and quick replies!

    I'd temper that desire with some caution, personally. You might make him look "on the ball" or you might make him look like a troublesome tenant for kicking up too much fuss over a fairly minimal issue (can't he handwash clothes or ask a friend for help?).

    It's all too easy for LLs to serve S21s to tenants who make too much fuss about nothing. Your encouragement for them to 'take him seriously' could land him with an eviction notice. Be careful.

    Can they still evict when rent has been paid in full for the term of the tenancy agreement?

    Why would they?

    If you own your own house and their is a delay in getting someone out to look at a faulty washing machine and a delay in getting a part, who will compensate you? Your building society? Mr Cameron? No one would, and you would just have to go to a friends or families or the launderette.

    Everyone is obsessed with compensation and won't accept that sometimes things happen that are outside of your control and you have to put up with a little bit of inconvenience. Its not like the sky is going to drop in or the world will stop turning.

    Point is Phil if i had my own house i would get someone to fix it there and then or buy a new one.

    When your renting... your not allowed to do anything like that. You are in a world of "Waiting for Authorization" ;)

    Not within a fixed term unless there has been a serious breach of contract by the T & then only with a court order

    But you are making an assumption that a) An engineer could come out immediately and b) that he had the part with him.

    Things don't happen that way. You will be lucky to get an enginneer out on the same day - allow 2 - 3 days at least. Then there is the part to get. Allow another 2 - 3 days, so you are looking at a week.

    If you bought one, you rarely get them delivered within 24 hours and then you need to get the old one taken away and the new one connected in. If you can do basic DIY, connecting the new one isn't, but for some people, they can't do that. So again, its going to be a number of days. And what are going to do about your washing in the intervening time? You'll have to go to a launderette or a mates house. Who is going to give you compensation then?

    So get your mate to go to the launderette, do it by hand (yes, you van do washing by hand) or you do it for him. Oh and tell him to stop winging.

    Not if he's still in a fixed term AST, however they can issue a Section 21 without needing any particular grounds whatsoever, to take effect at the end of the fixed term. If he's on a rolling contract they can issue one at two months' notice coinciding with the end of a rental period.

    And yes, of course it is only a notice and they would need a court order to get him evicted following that, but he'd be without a good reference and in a position of increased stress. Personally, I'd just do my washing in the sink and live with it. :)

    What a home owner would do/have to pay out for is totally irrelevant.

    Not sure why you struggle with the fact that your analogy is not relevant: your washing machine (if you are an OO) clearly has nothing to with Mr C or your mortgagor. However, a washing machine in a rental is the responsibility of the LL if he has provided it and the inventory and tenancy agreement confirm that repairs/maintenance are the LLs responsibility

    The point has already been made that much depends on how long the T would be without the use of the washing machine, provision of which ( in working order) is part of the tenancy deal in this case

    I think most would agree you with you if the repair is completed within a reasonable time. Much depends on how any request for reimbursement was actually phrased and ,as already stated, how long the T had been without the use of the washer.

    As for a retaliatory S21, LL would in turn probably end up with a void as T would be likely to refuse to allow viewings and sit tight until that court order was obtained.

    One LL describing a former T as a serial complainer ( even if that were true) is unlikely to put off all future potential LLs. Most LLs simply want to know if you (a) paid the rent in full and on time , and (b) if you looked after the property. Those who are experienced LLs understand that some LLs and some Ts just rub each other up the wrong way.
