    another one for the driver trying it on - funny how it was exactly £3 short wasn't it?

    we had a problem with justeat where we ordered chinese using the numbers eg number 52 peking duck - when the order came both mains were wrong so I rang justeat who told me to ring the takeaway, who told me that justeat had the numberings wrong online and they had delivered the corresponding numbers on their "correct" menu and so as far as they were concerned the order was complete, but I could have a discount on my next purchase for the hassle.

    I told them there wouldnt be a next purchase, and that the right dishes better be at my house within the hour or I'd kick up a major stink. the dishes did eventually arrive, the driver chucked them at my husband without a word before storming off!

    I would be so paranoid about there being something "added" in the food (spit/various bodily fluids), I couldn't eat it _pale_. Never complain to a takeaway and get new food delivered! Just ask for a refund if anything.
  • Just a quick update but I did ring the takeaway in the end and it does look like the driver was pulling a fast one, so something to watch out for in future I guess!

    Under curiosity where would I have stood if it had been a genuine mistake? I probably would've given them the extra £3 in that case (e.g. if they'd charged £1 for Haagen Dazs), but would I really be obliged to do so?

    I assume it would be similar to if they'd mispriced something in a shop i.e. don't have to sell it to me at the reduced price just because it's advertised as such, unless they accept payment in which case a contract is formed between us?
