tennant problem

Hi , I have a new tennant in my flat I rent out and yesterday the rent payment should have gone into my bank account but there is no sign and no sign of it today either , I have got to ring him today , can I charge a late payment fee if I have to wait for payment?

    I would speak to the tenant before you do anything.It may be the bank is at fault or a genuine mistake by the tenant.
    These things do sometimes happen with new tenant.

    Does the tenancy agreement you supplied have the provision for you to make a charge under these circumstances?

    If you haven't specified in advance (ie. in the tenancy agreement) that there would be late payment fees then no you can't. And even if you have specified in advance the charges must be reasonable.

    In my tenancy agreements I do specify a charge of £5 for late payment but have never actually charged it, I prefer to be more flexible and work things out with tenants, this promotes better landlord/tenant relationship and keeps everyone quite sweet.

    I have had this situation happen before and usually i have found its to do with banks. Because it was a Friday i would suggest the payment will perhaps go in on Monday. It happened all the time with one particular Tenant but it wasn't a problem.
  • Hi, if the tenant pays the rent by standing order and does not bank with the same bank as you.. even if he/she send the rent on date due your bank wil take a couple of working days to recive it..

    if they pay by cash though you should have it..
