2013 pip/dla

Can anyone please tell me about the new PIP Benefit coming into force in 2013.

I'm on DLA high rate care and mobility for an Indefinite period.
Am I correct in thinking that PIP will start on April the sixth 2013 being the new financial year? and where will I stand? because my 65th Birthday is on April the 8th 2013, does this mean I will not recieve the DLA high rate Care and Mobility I get now after the 6th of April? because I would be Two Days over the April the 6th time frame and therefore would I have to apply for PIP for two days and then two days later apply for Attendance Allowance?

    Its been endlessly discussed in this group for around 12 months now, it is not yet law [see the 3 sources below] and no firm decisions / dates / proposals / points criteria etc have been firmly fixed as of this date. All we truly know is regardless of which political party is in power unless there are a series of political & financial miracles .. .. its coming. A series of very many benefits from Housing / Social Care / Tax / Welfare / Spare Room / Attendance Allowance / Social Fund / ESA / Tax Credits / Carers Allowance / PIP / etc are going to become Universal [STRIKE]TeBBit[/STRIKE] Credit.

    There are five very key changes twixt DLA & PIP
    - .1. the assessment is 'points based' the very similar to the current EDA / WCA
    - .2. the PIP assessment has two clearly defined components, '(1) daily living activities' and '(2) mobility activities'
    - .3, each of the two components have activity descriptors ranging in value from 0 to 5 points
    - .4. each of the two components will have only a 'standard' and 'enhanced' rate, no lower rate as in DLA
    - .5. UNCLEAR - draft regs suggest a six month qualifying period after assessment but does not say if re-assessment will take place

    One further UNCLEAR .. .. at the moment a DLA award is not taken into account for means tested and other benefits. It is UNCLEAR to me that that will be the case when Universal Credit is rolled out, indeed whether the nasty party or one of the others its a possibility that with the intended 'Household Benefit Cap' which is part of UC will mean that DLA/PIP will affect the amount of credit awarded in the Universal Credit Scheme.

    Buried amongst these conglomeration of proposals is the transition from DLA to PIP. It's critically important to remember that neither DLA nor PIP are intended to be part of what will eventually become the new Universal Credit. The best way to understand PIP is to say that PIP is what we are left with when DLA is reformed, and needs to be completed before Universal Credit can be implemented.

    .1. the claimant .2. begs borrows or hires a bike; and .3. gets on it and endlessly pedals the length and breadth of this Island doing a 'Yosser Hughes' .4. Bicycle in this section does not mean a two wheeled conveyance powered using pedals but instead refers to the act of spending all ones waking hours looking for poorly paid work in rubbish conditions of a sort that would bring a smile to the sneering face of even the most heartless capitalist.

    In many cases, there are transitional periods.
    I understand that at the moment, people with an assessment date for DLA falling within one year of their 65th birthday do not get reassessed, but simply go onto AA at that time, without a reassessment.
    (I don't have reference for this - it was something I read in passing, and may have misunderstood)

    It would make little sense to not have something similar in place for PIP, to reduce the huge workload.

    In addition, PIP is being phased in, it's not everyone at the same time.
  • Assuming the O/P still passes the criteria, it depends on the claim date, 61551-61555 of the current DM's RogerBlack.

    New Claims

    - 61551 From 6.10.97, people aged 65 or over are no longer eligible to claim DLA
    - 61552 People who claim DLA before reaching the age of 651 but
    1. the claim was not determined until after they reached age 65 and
    2. at the time of their claim they did not have an award of DLA for a period ending on or after the day they reached age 65
    may be entitled to DLA
    - 61555 There is no upper age limit for receiving DLA beyond the age of 65, where the normal conditions of entitlement are satisfied

    Renewal Claims

    - 61557 People who are 65 or over are not prevented from making a renewal claim for DLA solely on the grounds of their age
    - 61558 A renewal claim from such a person can only succeed if
    1. it is made within twelve months of the end of the previous award and
    2. the person was aged 65 or over before their previous award ended
    - 61559 If a claim for DLA is made after a break of more than twelve months by a person whose award ended after age 65 or over, AA is available to them. The claim for DLA can be treated as a claim for AA
