Hope that this is in the correct section.
Does anyone know where we would stand on this. A month ago we ordered a new bed and mattress. The bed has got hydraulics, so that it lifts and you can use the whole space under the bed for storage. The mattress that we liked had a built in topper, was lovely and comfortable and the most expensive in the shop :eek: . We asked the sales man (who happened to be the manager) if the mattress would be OK with the particular bed that we chose. He said yes it was fine. He also said that if we didn't find the mattress comfortable, then we could exchange it within 30 days for a different one.
Anyway, we took delivery of the bed and mattress this afternoon and have spent ages putting it together. The men told us when they delivered the items that the mattress was the heaviest one that they sold. We tried out the storage space - lifting the bed and it worked great - until we got the mattress on it. We just can't lift the damn thing, it takes two of us to do it and then it means that someone has to be on hand to hold the bed up whilst you are getting something from it.
What would our rights be with regard to this? Would I have to take one of their mattresses which are similar to the one we already have or would we be entitled to our money back on it due to it not being compatible with the mechanics of the bed?

Seeing as the manager said the mattress would be ok, and it obviously isn't, and that he said you had a 30 day exchange option, then I would think that you will be safe to return it.
As to whether you would get a refund or a replacement - I'm not so sure.
He did say exchange rather than refund, but at the same time the goods aren't suitable for the purpose. You still need a mattress, so I would assume an exchange (and refund of any price difference) would be the best move anyway - and probably the one they will offer you.
I would start by contacting the store, but if their reply isn't satisfactory, then query it with local Trading Standards/CAB on Monday just to see where you stand legally

Could it be said that under the sale of goods act (not fit for purpose),the mattress is just that? Hope someone else can advise further,or ring consumer direct.If it is not fit for purpose you should be entitled to a refund.edit just fully read previous post-same.0

We went down to the bed shop today and spoke with the manager. He is trying to fob us off by ordering new hydraulics for the bed. I said to him that if they didn't work, I didn't want to get stuck with the mattress that we ordered but he hastily jumped on the offensive and more or less said that we would have to keep the mattress. We told him that the bed didn't work as it should do with the mattress that we had got - can't even lift the base up to use the storage space underneath. I will contact Trading Standards on Monday about this.
