Just started a DMP - can anyone help me and answer some PPI questions please?

Hi,
I've been advised to re-post this in here but I'm a bit nervous...I'm comfy on the debtfreewannabe boards, but scared in here (daft, I'm sure)
Here is my original post from yesterday-
We got a letter from Capital One today, and in the mini statement included, we noticed that the PPI payment of £70 had been taken out. They've asked us to stop using the card (which was cut up ages ago) but would they define this £70 coming out as 'use'?
I'm not sure how to get the payments stopped, it is as simple as a letter saying, please cancel the PPI and stop taking payments, perhaps even request that the latest payment be refunded as they already know we're on a DMP? (** Mr BR has since written and requested that they cancel the PPI immediately**)
Also, how might be go about reclaiming the whole PPI amount? Mr BR was given it when he took out the card years ago, and has never needed it, and misunderstood what it coved as the only time he's rung and tried to use it was when we couldn't make a repayment and he'd though the PPI was covering him for that sort of thing (it's not)

As far as reclaiming goes,you will need a reason for mis sell.It would seem your husband misunderstood what it covered,but that isn't neccesarily a mis sale it could be mis purchase.
Have you or your husband got any pre existing medical conditions that might mean the policy was invalid?
Have you got good sickness benefit at work that would mean the policy wasn't required?
Have you or had you any other means of making the payments if you were unemployed or ill such as savings or help from relatives?
How did you apply for the ppi,was it online or were you signed up in a phone call from cap one ?
I would put a complaint in using the best reasons you have and then post what cap one come back with.If they refuse your complaint then we can look at their reasons and try and combat them.;)0 -

See what reasons you might have for mis sale.
Concrete facts such as good sickness benefit at work or pre existing medical conditions are better than who said what when he took the policy out.
Whatever you decide are your best reasons for mis sell keep it factual and put a complaint in.They may well say no initially and may keep saying no,but there is nothing lost in trying
Cap One defend complaints quite strongly,but there have been some success stories.0 -

You will get all the help you need on the ppi reclaim,just ask.
Just to let you know,as you are on a dmp,any redress may be taken off the debt,you would need to discuss this with whoever the dmp is with.0 -
