How do I get insurance to pay back my excess?

I was just wondering if anyone could pass on some information as to how I could get back my car insurance excess which I've been waiting on for almost 2 years. Another driver went into the back of my car and admitted liability, went through the usual insurance procedure and paid my excess of £150. I got my car fixed through my insurance and they reinstated me to full no claims as it was the other drivers fault, however despite numerous phone calls I've still not received my excess back, what can I do?

Stop phoning. Write a letter headed boldly COMPLAINT. Give them 8 weeks to pay up then refer it to the ombudsman.

Ignore this advice to make a complaint! (You have nothing to complain about!)

Your excess is an uninsured item which you agreed to pay in the event you made a claim on the policy.

To get it back you need to pursue the third party/third party insurer.

So train your sights on them.

Sorry, you are correct. Has OP got legal expenses cover on their policy.
  • Your insurers will be able to give you the details of the TP insurer, their reference number & address. Send them a letter, ideally by special delivery, enclosing a copy of the receipt for the excess payment and a letter stating you want reimbursement.

This is exactly the sort of thing motor legal cover is there to cover.

The insurers will only claim their own costs, you have to claim your own separately.

Which is why it's often better to get the party at fault's insurer to pay for repairs directly rather than arranging it through your own insurer.

  • Thanks for replying, I had legal cover with them (Zurich) at the time, their response has been that they are waiting on payment from the third party (Tesco insurance). Funnily enough I received a letter from Tesco saying they would fix it themselves, pity it was at least 3 MONTHS AFTER the accident. So I should be writing to Tesco directly myself to try and receive my excess back? What options will I have after they ignore my letters? Apart from a Tesco boycott of my own theres not much I can do.....
  • You can write to them, you'll probably do it quicker than your insurers/ legal expenses will do it. If they do ignore it then ask your insurers why they havent appointed anyone under your LE policy to get your excess back
