Beachcollection non-booking/booking

Hope I can recieve some advice please. Stressed out.

Last Friday night I was booking a holiday (flights and accomodation) for all my family. Entered all details including credit card details giving £850 deposit out of £1550 When I got to the final page, I hit the confirm button>>>

"Oops... BeachCollection.co.uk has experienced a system error.
Please return to the homepage and start your search again to receive the most up to date prices and offers available for your perfect holiday.
Alternatively call us on 0871 702 9511 and we will be happy to assist you with your booking.
We're sorry for any inconvenience."

As it was getting late I could not be bothered inputing all details again.
First thing in the morning I telephoned them to enquire as to whether booking went through. Person on phone assured me that if I did not recieve an email confirmation, then the booking was not processed.


Anyway, I decided to take the kids elsewhere, locally by car. I recieved a hefty bill the same day from elsewhere. So I was glad the booking never went through.


Anyway, three days later I recieve a phone call from the the above company about the "processed booking". I told them that I was told on the phone that the booking never went through, and that my plans have changed.
"Would you like to cancel it sir? My response "yes"
"that will be a 35% charge" Aggggrgh . I tried to explain. Also spoke to one of the managers. They just will not budge. Manager insists that an email was sent. But that is not correct. I tend not to miss important emails. Not in my junk folder either.
I am not working at the moment. Been skimping and saving for ages.
Feel like I was mugged.

    I would put your complaint in writing.

    Just state that you originally visited their website, an error occured. You called to check if a booking had been made and it was confirmed by their staff it wasnt.

    Subsequently, you received a phonecall stating the booking had been processed but have received no other confirmation of this. You informed them you were of the understanding no contract existed and were told a 35% fee would apply for cancellation.

    State you would like them to cancel the booking free of charge due to their errors.

    Before doing this, call and ask what date the booking was made on. Check your bank and see what date the money was requested by them. Has it been requested by them at all?

    You can also try speaking to your local trading standards and see if they can offer any advice.


    Found this on their site relating to cancellation charges:
    *63 days or more: Total flight cost plus 35% of all other elements relating to the booking (or the deposit amount whichever is the greater)

    Money was taken two days after visiting their website.. Same day I received the phone call about the booking. I'll try and locate a local trading standards office here in Glasgow.
    Have already contacted the credit card company. But must wait 30 days before launching any dispute. Not sure if they will be of much use though.
